Acceptable Use Policy
1. Overview
This Acceptable Use Policy (“AUP”) establishes the standards for using our services responsibly. Its purpose is to protect our customers, infrastructure, and other internet users from unlawful, harmful, or disruptive activity.
This AUP forms part of our Terms of Service. It applies to customers, authorized account users, and anyone using services made available through a customer’s account.
You must ensure that your use of our services complies with this AUP, your purchased plan, and applicable law. The Terms of Service govern billing, refunds, liability, cancellation, and other contractual matters. Nothing in this AUP removes rights that cannot legally be waived.
2. Customer Responsibilities
You are responsible for the content, applications, and activities you authorize through your account. This includes websites, databases, files, plugins, themes, scripts, and communications.
You must:
Maintain accurate account and contact information.
Protect account credentials and use appropriate security controls.
Ensure that you have permission to publish and use your content and software.
Cooperate reasonably with investigations into security incidents or reported abuse.
Address security or compliance issues identified in a valid notice from Lucid Host.
Take reasonable steps to prevent unauthorized or abusive use of your account.
These responsibilities do not remove Lucid Host’s obligation to perform the management and other services expressly included in your plan.
3. Illegal, Fraudulent, and Harmful Activity
Our services must not be used to conduct, promote, or facilitate unlawful activity.
Prohibited uses include:
Fraud, phishing, identity theft, and deceptive impersonation.
Fraudulent investment schemes, counterfeit businesses, or websites designed to steal money or information.
Unlawful threats of violence or property damage.
Unlawful harassment, stalking, extortion, or disclosure of private information.
Sale or distribution of stolen information, unlawfully obtained credentials, or counterfeit goods.
Unlawful support for terrorism, including recruitment, financing, or operational coordination.
Activities that violate another person’s intellectual property, privacy, or other legal rights.
References to unlawful violence or terrorism do not prohibit legitimate journalism, education, research, or other lawful discussion that does not itself violate this policy.
4. Child Sexual Exploitation
Lucid Host prohibits material or activity that sexually exploits children.
This prohibition includes child sexual abuse material, sexual solicitation of minors, and content or services that facilitate, promote, or provide access to such exploitation. It also includes simulated or manipulated sexual depictions of minors prohibited by our services, whether or not a particular depiction is unlawful in every jurisdiction.
We may immediately restrict access to suspected exploitative material, preserve relevant information, and report matters to the appropriate authorities as required by law.
Do not attach or redistribute suspected child sexual abuse material when submitting a report. Provide the relevant URL and sufficient identifying information instead.
5. Unauthorized Access and Security Abuse
You must not use our services to access, interfere with, or compromise systems without authorization.
Prohibited activity includes:
Unauthorized access to accounts, devices, networks, or data.
Attempts to bypass authentication or security controls.
Unauthorized vulnerability scanning, penetration testing, or exploitation.
Interception or monitoring of traffic without permission.
Credential theft, password attacks, and session hijacking.
Altering or destroying another party’s data without authorization.
Concealing malicious activity through forged headers, deceptive routing information, or falsified identities.
Security testing must be authorized by the owner of the affected system. Testing that could affect Lucid Host infrastructure, shared resources, or other customers also requires our prior written approval.
Possession or legitimate use of a security tool does not, by itself, constitute a violation. Unauthorized, harmful, or disruptive use does.
6. Malware and Malicious Infrastructure
You must not knowingly host, distribute, execute, or facilitate malware or malicious infrastructure through our services.
This includes:
Viruses, ransomware, trojans, and malicious scripts.
Botnet command-and-control systems.
Software designed to steal credentials or confidential information.
Exploit services intended to compromise third-party systems.
Malicious redirects, drive-by downloads, and phishing kits.
Tools configured to conduct attacks or evade security restrictions.
If a website becomes compromised, we may isolate it, disable affected functionality, or restrict access to prevent further harm. We may require appropriate remediation before restoring normal service.
The discovery of compromised software does not automatically establish intentional misconduct by the customer. We will consider the circumstances, risk, and customer’s cooperation when deciding what action is appropriate.
7. WordPress, Plugins, and Themes
Customers must use WordPress, plugins, themes, and custom code consistently with the management responsibilities specified in their plan.
You must not knowingly install software that is malicious, unlawfully obtained, or materially unsafe. Any necessary commercial licenses must remain valid.
Lucid Host may restrict or disable a plugin, theme, script, or configuration that:
Creates a significant security vulnerability.
Causes repeated instability or excessive resource consumption.
Interferes with backups, updates, or essential hosting functions.
Violates this AUP or another applicable agreement.
Where practical, we will explain the issue and allow reasonable time to address it. Immediate restrictions may be necessary for an active threat or serious disruption.
Our ability to take protective action does not expand the management services included in your plan or remove our existing responsibilities.
8. Resource Usage and Permitted Workloads
Our managed WordPress hosting services are intended to support websites and their ordinary operation within the limits of the purchased plan.
You must not deliberately overload or materially disrupt shared resources, including processing capacity, memory, storage, databases, network connections, or email systems.
Prohibited uses, unless expressly supported by your plan and approved by Lucid Host, include:
Cryptocurrency mining.
Game servers.
Public proxy services or open relays.
Unrelated IRC servers or persistent network services.
Large-scale file distribution unrelated to the hosted website.
General-purpose computing jobs unrelated to the hosting service.
Scripts intended to evade limits or consume excessive resources.
Shared hosting must not be used primarily as a personal storage repository, general backup destination, or long-term archive. Website-related backups remain subject to your plan’s storage and retention rules.
High traffic alone is not necessarily abuse. If legitimate demand exceeds your plan, we may recommend optimization or a suitable service adjustment.
Except where immediate action is necessary, we will provide notice before imposing a material restriction. Additional charges or paid upgrades require the authorization described in our Terms of Service.
9. Email and Spam
You must not use our services to send spam, operate an open mail relay, distribute deceptive messages, or facilitate abusive email activity.
You must not knowingly use unsolicited or deceptive campaigns to promote a website hosted by Lucid Host, including campaigns sent by someone acting on your behalf through another provider.
Where your plan permits promotional email, Lucid Host requires confirmed opt-in mailing lists unless we expressly approve another arrangement. This is a service requirement, separate from applicable legal requirements. You must retain reasonable evidence of permission.
Commercial messages must comply with applicable law, including the CAN-SPAM Act where applicable. Requirements include accurate sender information, nondeceptive subject lines, required sender disclosures, and a working unsubscribe process. Opt-out requests must be honored within applicable deadlines.
Ordinary transactional messages, such as order confirmations and password resets, may be sent where supported by your plan. They must not be used to disguise unsolicited advertising.
Bulk campaigns must use a delivery service appropriate for their volume. Permission to host a website does not automatically include permission to send bulk email through the hosting server.
We may restrict email activity that generates significant abuse complaints, harms delivery systems, or violates disclosed sending limits.
10. Denial-of-Service Attacks
Outgoing attacks
You must not use Lucid Host services to originate, coordinate, amplify, or assist denial-of-service attacks against any system.
If an account or website is transmitting attack traffic, we may immediately block that traffic or suspend the affected service. We may require remediation and reasonable evidence that the cause has been addressed before restoring access.
Intentional attacks, repeated incidents, or failure to cooperate with necessary remediation may result in termination under our Terms of Service.
Incoming attacks
Being the target of an incoming attack does not, by itself, constitute an AUP violation.
To protect infrastructure and other customers, we may temporarily filter traffic, restrict connections, isolate an affected website, or block traffic to an affected address.
Where practical, we will notify the customer and review whether restrictions can be safely reduced or removed. We do not guarantee that every attack can be prevented or successfully mitigated.
If continued hosting presents an unresolved material risk, we may discuss alternative arrangements or discontinue the affected service under our Terms of Service. Any refund, export, or termination rights remain governed by those Terms and applicable law.
11. Domains and Related Services
Domains registered or managed through Lucid Host must not be used in connection with phishing, malware distribution, fraud, or other activity prohibited by this AUP.
Domain services are also subject to applicable registrar agreements, registry requirements, and domain policies.
Any domain suspension, transfer restriction, or other enforcement action must comply with those requirements. Suspending hosting does not automatically cancel a domain registration or remove the registrant’s applicable rights.
Domain ownership, renewal, expiration, and transfer matters are addressed in our Terms of Service and applicable domain agreements.
12. Investigations and Enforcement
Lucid Host may investigate credible reports or indications of an AUP violation. Our review may include relevant account information, technical logs, and affected content, subject to applicable law and our privacy obligations.
Depending on the circumstances, we may:
Request an explanation or corrective action.
Issue a warning.
Restrict a particular feature or application.
Remove or disable access to affected content.
Temporarily suspend an affected service.
Terminate service in accordance with our Terms of Service.
Preserve or disclose information where legally required.
We will consider the seriousness of the issue, its effect on others, whether it appears intentional, previous incidents, and the customer’s response.
For issues that can reasonably be corrected, we will ordinarily provide notice and an opportunity to respond. Immediate action may be necessary for serious unlawful activity, active security threats, significant disruption, or legal requirements.
Failure to respond within a reasonable deadline identified in an abuse notice may result in continued restriction, suspension, or termination.
We will seek to limit enforcement to the affected service where practical. Broader restrictions may be necessary where there is evidence that multiple services are involved or a shared risk remains.
Any fees, refunds, payment disputes, and data-retention consequences are governed by our Terms of Service. This AUP does not impose separate fixed abuse penalties.
13. Customers Managing Websites for Others
If your plan permits you to manage websites for clients or other authorized users, you must take reasonable steps to ensure that their use complies with this AUP.
We may contact you about an affected website and require you to coordinate a response.
Where practical, we will restrict the affected website rather than unrelated websites. Repeated violations, failure to address a material risk, or abuse affecting the broader account may justify further action under our Terms of Service.
14. Reporting Violations
Report suspected violations to:
Include as much of the following information as reasonably available:
Your name or organization and a working contact email.
The affected domain, exact URL, or other identifying information.
A description of the activity and why you believe it violates this AUP or applicable law.
Relevant dates, times, and time zone.
Supporting evidence, such as screenshots, message headers, or technical logs.
Any existing ticket or reference number.
An IP address can help, but a report will not be rejected solely because the website uses a content delivery network or an address not directly owned by Lucid Host.
Do not send account passwords, unnecessary identity documents, or other sensitive information unless specifically requested through an appropriate secure process.
Ordinary reports may be submitted by email. A passport, notarized statement, or PDF attachment is not generally required. Additional information may be necessary for a particular legal notice or to verify a claim.
Do not direct reports to employees’ personal email addresses or telephone numbers.
15. Complaint Handling and Copyright Reports
We review reports in good faith and may request clarification or supporting evidence. A report does not automatically establish a violation or require removal of the reported material.
We may notify the affected customer and share information reasonably necessary to investigate or respond, subject to privacy obligations, legal restrictions, and appropriate protection of sensitive information.
Copyright reports should identify the work concerned, the allegedly infringing material, its location, and the reporting party’s authority to act. Statutory copyright notices and counter-notices may require additional information and must follow the applicable legal procedure.
We will comply with applicable legal orders and notice requirements. We may terminate repeat infringers in appropriate circumstances.
We do not require a complainant to waive legal rights or accept liability merely to submit a good-faith report. Knowingly false allegations, forged evidence, and attempts to misuse the reporting process may themselves result in action where appropriate.
Reasonable follow-ups, corrected reports, and lawful automated reporting are not prohibited. We may organize or limit duplicative or harassing communications while preserving a reasonable route for legitimate notices and material new information.
For privacy and security reasons, we may be unable to disclose all investigation details or actions taken.
16. Requests for Review
A customer who believes an enforcement action was taken in error may request review by replying to the relevant notice or emailing abuse@lucidhosts.com.
Include:
The affected account, website, or service.
The notice or ticket reference, if available.
An explanation of why the action should be reconsidered.
Supporting information and any remediation already completed.
We will review relevant information and may maintain, modify, or reverse the action.
A review request does not automatically restore service. Restrictions may remain where a material risk or legal requirement continues.
This process does not replace or restrict any statutory counter-notice procedure, court remedy, or other legal right.
17. Suspension, Data Access, and Backups
Access to a website, dashboard, or stored files may be restricted during an abuse or security investigation.
Where practical and legally permitted, we may provide a safe method to retrieve legitimate customer data without restoring harmful activity.
Data export, retention, deletion, and backup availability remain governed by your service plan and our Terms of Service. This AUP does not promise indefinite retention, uninterrupted access, or successful recovery of lost data.
You should maintain independent copies of important information. That responsibility does not remove any backup obligations expressly included in your purchased service.
18. Governing Law and Policy Changes
This AUP is governed by the law and dispute provisions in Lucid Host’s Terms of Service, including Florida law and applicable United States federal law, subject to mandatory protections that apply to you.
We may update this AUP to address changes in services, security risks, operational requirements, or applicable law.
Material changes will be communicated and take effect according to the notice and acceptance provisions in our Terms of Service. We will obtain additional consent where required by law.
Changes will not be applied retroactively to remove rights or resolve an existing dispute under terms that did not apply when the relevant events occurred.
